Welcome to Gmarket Global. Buyers registered with Gmarket Global will be able to enjoy the rights and privileges described in these Gmarket Global Terms of Service (these "Gmarket Global Terms of Service") when purchasing Marketplace Items (as defined below) from any of our participating Sellers on Gmarket Global . Selection by Gmarket Global (such as Sellers, “Mall Sellers” and such Buyers, “Mall Buyers”). If you are a mall buyer, you will be deemed to have agreed to the terms and conditions stated in this Gmarket Global Terms of Service when you shop at Gmarket Global. Likewise, if you are a mall seller, your continued participation in Gmarket Global will be deemed to be your agreement to the terms and conditions stated in this Gmarket Global Terms of Service. These Gmarket Global Terms of Service are in addition to the Terms of Service and other Gmarket Global policies of which these Gmarket Global Terms of Service form part - please read the Terms of Service and other Gmarket Global policies available on the website as they contain important information about your rights Information and Obligations. Any terms used in these Gmarket Global Terms of Service that are not defined herein will have the meaning given to such terms in the Terms of Service and/or applicable Gmarket Global policies. All terms and conditions described in the Gmarket Global Terms of Service are subject to change at the sole discretion of Gmarket Global in accordance with the Terms of Service.
1.Gmarket Global Refund and Return Policy
1.1 Mall buyers may have seven calendar days following the date on which the mall products are first available for pickup by mall buyers (the “free return period”). Typically, this date is the date on which the marketplace buyer receives delivery of the mall item; however, if the mall buyer does not receive the mall item because the mall buyer is not at the destination address or the mall buyer fails to enter the correct destination address, then that date will be the date of the first delivery attempt.
1.2 Please note that the mall buyer must ship or deliver the mall items to the location or location designated by Gmarket Global within five days after making a return request, and in any case not later than the last day of the free return period. All returned mall items must be returned via Gmarket Global’s designated courier no later than the last day of the free return period. Gmarket Global reserves the right to reject any request to ship a Marketplace item after five days of the return request.
1.3Gmarket Global will approve your refund and return request at its sole discretion after reviewing your completed refund/return request and checking the condition of the returned mall items. The mall buyer acknowledges and agrees that the decision of Gmarket Global is final, conclusive and binding, and undertakes and agrees not to file a lawsuit or otherwise make any claim against Gmarket Global or its affiliates with respect to such decision. Mall items returned to Gmarket Global must meet at least the following conditions:
● Brand new and sealed;
● Complete, including all items purchased;
● Comes with original product packaging and price tag.
If any additional conditions apply to a mall project, Gmarket Global will notify you via the website, SMS or email. The return conditions for products on the Mall are collectively referred to as "Return Conditions".
1.4 In addition, please note that certain types of mall items may be excluded from the refund and return policies described in these Gmarket Global Terms of Service, including:
● Digital goods, such as mobile phone recharge cards, audio and video recordings or software, etc.;
● Goods that are perishable or may spoil or expire quickly, such as groceries;
● Cosmetics, swimwear, underwear and other products that are not suitable for return due to health protection or hygiene reasons.
If any mall items are excluded from the refund and return policies stated in these Gmarket Global Terms of Service, Gmarket Global will use reasonable efforts to post that information on our website or otherwise notify mall buyers; however, please Note that our policies may change at any time without prior notice, and certain Marketplace items may be excluded after purchase by Marketplace buyers. Any mall products that are excluded from the refund and return policies stated in these Gmarket Global Terms of Service are referred to as "excluded products".
1.5Gmarket Global reserves the right to (a) add or otherwise modify the list of excluded items and/or return conditions and (b) modify, terminate or suspend the refund and return policies described in these Gmarket Global Terms of Service (including free returns) period), in each case at its sole discretion at any time.
1.6Gmarket Global may refuse any returned Marketplace items (and associated refund and return requests) at its sole discretion:
● Belongs to excluded items;
● Not meeting the conditions for return;
● If the Mall Goods are returned in a manner that does not comply with Article 1.2 above.
Please note that Gmarket Global’s decision will be based on the list of conditions and terms in effect at the time such decision is made (including the list of excluded items, return conditions and free returns period) and therefore such list of excluded items, return conditions shall be subject to clause 1.5 above. and/or the length of the free return period may differ from what is in effect when a marketplace buyer completes a refund/return request and/or returns an item to the marketplace.
If Gmarket Global rejects the refund and return request, Gmarket Global will organize the shipping of the Mall item to the relevant Mall buyer address where the Mall item was originally delivered, and Gmarket Global has the right to claim compensation from the Mall buyer for any costs incurred therefrom. The mall items are returned to the mall buyer.
1.7 If Gmarket Global suspects that a user is abusing the refund and return policy described in these Gmarket Global Terms of Service, Gmarket Global reserves the right to terminate the user's access to Gmarket Global and, if Gmarket Global deems it appropriate, may also impose fines (including pursuing Recover any fees or charges incurred) due to such abuse).
1.8 The mall product refund and return policy described in these Gmarket Global Terms of Service is in addition to the general refund and return policy described in the Refund and Return Policy. In the event of any inconsistency, the refund and return policies described in these Gmarket Global Terms of Service will apply to the mall items.

2. Mall Seller Terms and Conditions
2.1 If you are a mall seller, you should receive a separate written notice from Gmarket Global informing you of your choice to participate in Gmarket Global. If you decide not to participate in Gmarket Global at any time, please notify Gmarket Global in writing; otherwise, you will be deemed to have chosen to continue participating in Gmarket Global and to have agreed to the terms and conditions set forth in this Gmarket Global Terms of Service.
2.2 Each Mall Seller warrants that the Mall Products it offers on Gmarket Global and actually delivers to Mall Buyers (a) comply with (i) applicable law and (ii) the specifications listed on the Website (and provided to Mall Buyers), including any and all product warranties, specifications, drawings, samples, performance standards and all applicable quality, safety and health requirements, and (b) will be free from defects. Each mall seller understands and agrees that it will be responsible for any nonconformity or defect in any mall merchandise, or any public or private recall, and will hold Gmarket Global harmless from any losses related to the above.
2.3 If a mall seller is found to be offering or selling any mall items on Gmarket Global that are subject to Gmarket Global’s prohibited and restricted items policy, Gmarket Global reserves the right to remove the offending mall items from Gmarket Global and perform refunds (and any adjustments) at its sole discretion. A Mall Buyer who purchases such Mall Items (even if the Mall Buyer fails to comply with any of the requirements set forth in Section 1 above), in which case the Mall Seller agrees to reimburse Gmarket Global for all such refunds (including any related costs and fees) and authorizes Gmarket Global to deduct such amounts from any amounts due to Mall Sellers or to take other actions that Gmarket Global deems appropriate in its sole discretion.
2.4Gmarket Global’s decision to approve a refund or return in accordance with Article 1 above is binding on the relevant mall seller. The Mall Seller agrees to comply with and do all things necessary to effectuate the refund or return request from the Mall Buyer and obtain approval from Gmarket Global.
2.5 For any refund or return request approved by Gmarket Global, Gmarket Global will organize the transportation of the relevant returned Mall Item to the address provided by the relevant Mall seller in writing to Gmarket Global to complete the refund and return process at no additional charge. Such Marketplace Sellers provide that the address is located in the country in which the relevant Marketplace Products are listed for sale on the Website (the "Local Address"). If the Mall Seller fails to provide a local address for the returned Mall Items or fails to accept delivery of the returned Mall Items within a reasonable time (as determined by Gmarket Global), Gmarket Global reserves the right to dispose of such Mall Items as it deems appropriate. In any way, the mall seller shall be deemed to have lost all rights to the mall items.
2.6 Notwithstanding the above provisions, Gmarket Global may, at its sole discretion, decide not to return the mall products that have been approved for refund or return to the mall seller, and the mall seller will be deemed to have given up all rights to the mall products.
2.7 For any refund or return that Gmarket Global receives but is rejected by Gmarket Global, Gmarket Global will organize the shipping of the mall items to the address of the relevant mall buyer in accordance with Article 1.6 above.
2.8 If Gmarket Global approves any refund or return request, the Mall Seller may appeal the decision by contacting Gmarket Global and providing evidence to support the appeal. If Gmarket Global supports the mall seller's appeal, it will pay all or part of the buyer's purchase price to the mall seller. The mall seller acknowledges and agrees that Gmarket Global’s decision is final, conclusive and binding, and undertakes and agrees not to initiate litigation or otherwise make any claims against Gmarket Global or its affiliates in connection with this decision.
3.Gmarket Global 100% genuine policy
3.1 All products listed by mall sellers must be 100% authentic.
3.2 It is prohibited to list counterfeit products on Gmarket Global. The term "counterfeit" includes products that are manufactured in exact imitation of an existing brand with the intent to deceive or defraud and may include, but are not limited to:
● Products that violate the laws of any country in which they are sold;
● Counterfeits or copies of existing official products;
● Products that have never been manufactured by a specific brand;
● Products with obviously too low prices;
● Products containing a registered trademark on the product, packaging or anywhere related to the product without authorization from the trademark owner;
● Products that contain specific design elements protected by trademarks (such as cartoon characters or color combinations); without authorization from the trademark owner;
● Products that bear such similarities to other products without authorization from the trademark owner (for example, copies of branded goods with or without altered logos);
● The product does not have an obvious trademark on the product picture on the listing, but the delivered product contains the trademark; and
● Use photos with branding in your listings.
3.3 Original Equipment Manufacturer ("OEM") branding is permitted as long as the official brand logo is not displayed on any OEM product image and the official brand name is not noted in any part of the product information.
3.4 If requested by Gmarket Global, the Mall Seller shall promptly provide Gmarket Global with documents proving (to the reasonable satisfaction of Gmarket Global) the authenticity of the Mall Items, including but not limited to the manufacturer’s sales invoice, authorized distribution agreement and/or certificate of authenticity (“Authenticity prove").
3.5 If the mall seller fails to provide proof of authenticity, the mall seller should:
(a) Accept mall items returned by mall buyers;
(b) Be responsible for indemnifying Gmarket Global for other costs, expenses, losses and liabilities (including but not limited to loss of goodwill) suffered or incurred by Gmarket Global as determined by Gmarket Global in its sole discretion.

3.6 If Gmarket Global determines in its sole discretion that a mall seller has violated Article 3, Gmarket Global may take all appropriate measures, including but not limited to deleting the counterfeit mall product listings from the website, prohibiting the posting of identical or similar products and/or restricting, suspending or terminating Mall seller's Gmarket Global account and/or access to Gmarket Global. The obligations and responsibilities of the Mall Seller under these Terms of Service are not affected by the restriction, suspension or termination of the Mall Seller's account.
4.Gmarket Global commission fees
4.1Gmarket Global charges a fee ("Gmarket Global commission fee") for all successful transactions completed by mall sellers on the website. Gmarket Global commission is borne by the mall seller and is calculated as (a) two percent (2%) of the total settlement price for the sale of electronic products (such as audio, cameras and drones, computers and accessories, games and consoles, Mobile phones and gadgets, home appliances) (b) Three percent (3%) of the total settlement price for sales of fast moving consumer goods (such as beauty, food and beverages, health products, mother and baby, pets, home & living - Home Fragrance and aromatherapy, home & living - home care products); (c) Five percent (5%) of the total settlement price for the sale of any other products not otherwise provided for herein. The total settlement price is the seller's original listing price for the item, minus any marketplace seller-sponsored discounts or coupons, rounded to the nearest peso. For the avoidance of doubt, the classification of items specified in clause 4.1 (a), (b) or (c) above shall be determined by Gmarket Global in its sole discretion. Gmarket Global commissions include VAT. Gmarket Global shall issue a receipt or tax invoice for Gmarket Global commission fees after the mall seller submits the registration certificate to the IRS.
4.2 After the transaction is successfully completed, Gmarket Global shall deduct the Gmarket Global commission from the buyer's purchase amount and remit the balance to the mall seller in accordance with the provisions of Article 11.2 of these Terms of Service.
4.3 For the avoidance of doubt, in addition to the transaction fees under the Terms of Service, the Gmarket Global commission fees under these Gmarket Global Terms of Service apply.
5.Gmarket Global milk powder guarantee
5.1 The Gmarket Global Formula Guarantee Program is Gmarket Global’s commitment to brand authenticity and product freshness for every qualified formula product.
5.2 If the eligible formula product complies with Gmarket Global’s 100% genuine product policy as described in Section 3 above, the mall buyer can apply for refunds and returns. or (b) the expiration date of the Eligible Formula Product is less than six (6) months from the date of the first attempted delivery of such Eligible Formula Product (the "Freshness Guarantee").
5.3 If an eligible milk powder product does not comply with (a) Gmarket Global’s 100% genuine product policy in Section 5.2(a) above, the affected mall buyer shall refund 200% of the buyer’s purchase price, and (b) freshness Subject to Section 5.2(b) above, affected mall buyers shall be refunded 100% of the buyer's purchase price. All refunds shall be made via the same method of payment as the original payment method, unless the payment method was cash on delivery, in which case the refund shall be credited to the marketplace buyer's e-wallet.
5.4Gmarket Global reserves the right, at its sole discretion and without prior notice, to reject, reject or exclude claims made by mall buyers under this Gmarket Global guarantee, including (but not limited to) refund and return claims that are incomplete, incorrect, incorrect, - Comply or fail to perform any applicable terms, or attempt to damage or tamper with eligible milk powder products. Gmarket Global reserves the right not to disclose the reasons for failed claims. No letters will be accepted.
5.5 All decisions of Gmarket Global regarding this Gmarket Global guarantee are final and binding, including but not limited to the identification of eligible claimants, the number of submissions per claimant, legibility of photos and submissions, time and date cutoffs , limitations on Gmarket Global guarantees, and maximum refund amounts.
